国务院办公厅印发意见 进一步规范行政裁量权基准制定和管理工作

新华社北京8月17日电 近日，国务院办公厅印发《关于进一步规范行政裁量权基准制定和管理工作的意见》（以下简称《意见》），就进一步规范行政裁量权基准制定和管理工作有关事项提出明确要求。

Beijing, Aug. 17 (Xinhua) -- Recently, The General Office of the State Council issued the Opinions on Further standardizing the Formulation and Management of Administrative Discretion Benchmarks (hereinafter referred to as the Opinions), which set out clear requirements on matters related to further standardizing the formulation and management of administrative discretion benchmarks.

《意见》指出，行政裁量权基准是行政机关结合本地区本部门行政管理实际，按照裁量涉及的不同事实和情节，对法律、法规、规章中的原则性规定或者具有一定弹性的执法权限、裁量幅度等内容进行细化量化，以特定形式向社会公布并施行的具体执法尺度和标准。规范行政裁量权基准制定和管理，对保障法律、法规、规章有效实施，规范行政执法行为，维护社会公平正义具有重要意义。

《意见》强调，规范行政裁量权基准制定和管理工作，要坚持以习近平新时代中国特色社会主义思想为指导，坚持法制统一、程序公正、公平合理、高效便民等原则，确保行政机关在具体行政执法过程中有细化量化的执法尺度，行政裁量权边界明晰，行政处罚、行政许可、行政征收征用、行政确认、行政给付、行政强制、行政检查等行为得到有效规范，行政执法质量和效能大幅提升，社会满意度显著提高。

《意见》明确，要严格履行行政裁量权基准制定职责，严格规范行政裁量权基准制定权限。行政机关可以根据工作需要依法制定行政裁量权基准。要准确规定行政裁量权基准内容，推动行政处罚裁量适当、行政许可便捷高效、行政征收征用公平合理，规范行政确认、行政给付、行政强制和行政检查行为。要严格行政裁量权基准制定程序，加强制发程序管理，健全工作机制，根据行政裁量权的类型确定行政裁量权基准的发布形式。充分研究论证，确保行政执法适用的具体标准科学合理、管用好用。

《意见》提出，要规范适用行政裁量权基准，发现适用的行政裁量权基准可能出现明显不当、显失公平，或者行政裁量权基准适用的客观情况发生变化的，要严格按照规定调整适用。要加强行政裁量权基准管理，强化日常监督管理，加强对行政裁量权基准制度执行情况的监督检查，建立行政裁量权基准动态调整机制。大力推进技术应用，将行政裁量权基准内容嵌入行政执法信息系统，为行政执法人员提供精准指引，有效规范行政裁量权行使。各地区各部门要高度重视行政裁量权基准制定和管理工作，加强统筹协调，明确任务分工，强化宣传培训，抓好贯彻落实。
