辽宁：高质量开展民事再审审判业务培训

Liaoning: Carry out high-quality training in civil retrial trial business

日前，辽宁省高级人民法院举办全省民事再审审判业务培训班。本次培训为期5天，紧紧围绕民商事审判热点难点问题，课程内容“干货”满满，授课讲师为业界“顶流”或“新秀”。该期培训的成功举办成为辽宁司法培训新“标杆”。

A few days ago, the Liaoning Provincial High People's Court held a training course on civil retrial trial business in the province. The training lasted for 5 days, closely focusing on the hot and difficult issues in civil and commercial adjudication, the course content was full of "dry goods", and the lecturers were "top streams" or "rookies" in the industry. The successful holding of this training has become a new "benchmark" for judicial training in Liaoning.

本次培训课程设置坚持强化政治理论，专门安排学习习近平法治思想；突出问题导向，在全省征集170个法律问题基础上，结合最高法院职能部门意见进行设计。实务课程主要内容包括，新修正的民事诉讼法及司法解释、民法典审判实务、民商事再审典型案例，以及破产案件和金融案件等当前审判实践热点。理论讲授与研讨相结合，选取优秀案例，集体研讨交流，提炼审判规则，统一裁判尺度。

This training course is set up to adhere to the strengthening of political theory, and specially arranges to study Xi Jinping Thought on the Rule of Law; Highlight the problem orientation, on the basis of the collection of 170 legal issues in the province, combined with the opinions of the functional departments of the Supreme Court. The main contents of the practical course include the newly revised Civil Procedure Law and Judicial Interpretation, the trial practice of the Civil Code, typical cases of civil and commercial retrial, and the current hot spots of trial practice such as bankruptcy cases and financial cases. Combine theoretical teaching and discussion, select excellent cases, collectively discuss and exchange, refine trial rules, and unify adjudication standards.

据介绍，培训力量投入空前。邀请法律权威授课，授课的9位资深法官中，有7位来自最高人民法院，2位来自省高院。其中，有6人获评“全国审判专家”称号。此外，青年“新秀”代表、驻辽宁高院第一批“审学研”研究员的登台，也成为本次培训一大亮点，标志着辽宁高院“审学研”一体化机制建设“以调研促培训，以培训促审判，选育管用一体推进”的高层次审判人才闭环培养和良性循环新模式，在培训领域成功实现成果转化。

Among the 9 senior judges who invited legal authorities to give lectures, 7 were from the Supreme People's Court and 2 from the Provincial High Court. Among them, 6 people were awarded the title of "National Trial Experts". In addition, the appearance of the representative of the young "rookie" and the first batch of researchers of the Liaoning Higher People's Court for "trial study and research" has also become a major highlight of this training, marking the construction of the integrated mechanism of the "trial study and research" of the Liaoning Higher People's Court, "to promote training through research, to promote trial with training, to promote trial with training, and to promote the integration of breeding and management", and to successfully achieve the transformation of achievements in the field of training.

培训期间还套开了全省民事再审工作会议。

During the training period, a provincial civil retrial work conference was also held.

全国审判专家、辽宁高院审判委员会专职委员杨悦作开班动员。全省200余名民事法官参加培训，部分辽宁省人民检察院检察官同堂参训。

Yang Yue, a national trial expert and full-time member of the Liaoning Higher People's Court's adjudication committee, made a mobilization for the opening of the class. More than 200 civil judges from all over the province participated in the training, and some procurators of the Liaoning Provincial People's Procuratorate participated in the training in the same classroom.
