据中国外交部此前声明，该飞艇来自中国，属民用性质，用于气象等科研。受西风带影响，且自身控制能力有限，该飞艇严重偏离预定航线。中方对飞艇因不可抗力误入美国表示遗憾。

不构成军事和人身威胁

中国政法大学航空与空间法研究中心研究员孔得建分析称，根据“不得对民用航空器使用武力”的国际惯例或国际习惯法原则，在该民用无人飞艇并没有对美国造成现实紧迫危险的情况下，美国政府将其击落的必要性并不充足。

Kong Dejian, a researcher at the Aviation and Space Law Research Center of China University of Political Science and Law, said that according to the international practice or international customary law principle of "no use of force against civil aircraft," the necessity for the US government to shoot down the unmanned airship was not sufficient when the unmanned airship did not pose an imminent danger to the United States.

孔得建同时认为，根据《国际民用航空公约》第二十五条规定，中国外交部已明确表示，该民用无人飞艇已经失去有效控制，其作为民用航空器的状态为“遇险的航空器”，美国本应当对此采取适当的援助措施，而非将其击落。

“中国民用无人飞艇误入美领空是由不可抗力导致的意外、偶发事件，不会对人员构成任何威胁。”朱耀春认为，美方执意对即将离开美领空的中国民用无人飞艇滥用武力，既不合法，也不合理，明显反应过度，严重违反《国际民用航空公约》等国际法精神，严重违反国际惯例。
